JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and allegedly, they along with other accused assaulted the deceased by fists and slaps and also jumped on his chest with intent to commit his murder and subsequently, the deceased died. Moreover, the impugned order shows that no injury was found on the chest of the deceased and even if the aforesaid accusation assumed to be true, then also, it appears that it is a case of Section 304 of the Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released
