JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have assaulted the informant by means of iron rod whereas; other accused assaulted him (the informant) by Lathi as well as Dabiya.

There is specific allegation against co-accused, Deepu Rai that he gave Dabiya blow, causing head injury to the injured. The injured has sustained altogether four injuries and out of which; one injury i.e. on left scapular region, was grievous in nature. Moreover, there was land dispute between the parties and after the alleged occurrence, a complaint case was filed by the petitioner and the said complaint case was converted in police case.

No.8019 of 2016 (2) dt.19-02-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chanpatia P.S. Case No. 262 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran.
