====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2020 Heard Mr. Sumit Shekhar Pandey, learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Katra P.S. Case No. 28 of 2020 dated 08.02.2020 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

According to the prosecution report, 138 litres of liquor is said to have been recovered from the possession of the petitioner which the petitioner claims has wrongly been saddled upon him.

The petitioner is in custody since 03.07.2020 and does not have criminal antecedent.

Regard being had to the aforestated facts, the

Patna High Court CR. MISC. No.32464 of 2020(2) dt.08-12-2020 2/2 petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur, Bihar in connection with Katra P.S. Case No. 28 of 2020.
