No doubt, petitioner is named in the first information report but general allegation of assault has been levelled against the petitioner and so far as specific allegation of assault is concerned, the same is against co-accused Pramod Singh who gave several rod blows on the head of the deceased.
It appears that after alleged occurrence when the deceased was examined by the Medical officer, Sadar hospital, Nawada, the said doctor found only one swelling 1" x 1" on occipital region of the deceased but it is informed that in course of post mortem examination, altogether four injuries were found on the person of the deceased. Furthermore, I find that after due investigation, police submitted final form against the petitioner but the concerned court took cognizance against the petitioner also.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.1748 of 2015 (2) dt.15-01-2015 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Nawada in Narhat P.S.
