2. The Senior Superintendent of Police, Muzaffarpur vide its letter no. 599 dated 24.07.2025 submitted a report that the sole appellant is no more alive. The aforesaid fact regarding the death of the sole appellant, has also been certified by the Mukhiya of the Gram Panchayat Raj, Turki West, Minapur, Muzaffarpur dated 23.07.2025 that the sole appellant has already died two years ago; similar is the certificate of the concerned police station.

3. Considering the facts that the sole appellant has already died during the pendency of the present criminal appeal, and there is no near relative, who intended to continue the

Patna High Court CR. APP (DB) No.74 of 2000(7) dt.29-11-2025 2/2 appeal, the same stands abated.

4. The office is directed to return the Lower Court Record to the learned trial Court.

5. The criminal appeal stands disposed off.
