The petitioner seeks bail in Saur Bazar(Pastpar) P.S. Case No.501 of 2019 registered under Section 392 of the Indian Penal Code.
The informant, owner of the petrol pump, alleged that on 29.12.2019, two motorcycle borne criminals snatched Rs.1,30,200/- from his staffs. The criminals had come on a Splendor and Apache motorcycle.
The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of Keshav Kumar which is also a part of the F.I.R. It is submitted that petitioner has not been put on T.I.P. and he is in custody since 26.04.2020. No looted article was recovered from the
Patna High Court CR. MISC. No.32344 of 2020(2) dt.07-12-2020 2/2 possession of the petitioner. Petitioner has got no criminal antecedent.
Taking into consideration the fact that the name of the petitioner surfaced in the case on the confessional statement of co-accused and on such, the petitioner was apprehended on 26.04.2020 but he has not been put on T.I.P. and he has got no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar(Pastpar) P.S.
