The petitioner seeks bail in a case registered under Sections 8, 20(b)(11)(c), 25 of the N.D.P.S. Act.

The prosecution case, in short, is that 10 kg ganja is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.01.2019 has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 10 kg ganja is recovered from the half constructed house of the petitioner. The quantity in question is below the commercial quantity. There is no compliance of Sections 42 and 50 of the N.D.P.S. Act.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with N.D.P.S. case No.03 of 2019, Barachatti P.S. case No.18 of 2019.
