JUSTICE SUDHIR SINGH ORAL ORDER 15-11-2021 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. Counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

The petitioners are apprehending their arrest in connection with Deo P.S. case No.27/2021 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 447, 504, 506 of the Indian Penal Code. Later on, Section 302 of I.P.C. has been added.

No.44685 of 2021(2) dt.15-11-2021 2/3 The prosecution case, in short, is that the accused persons including the petitioners armed with tangi, bhala, rod and danda came and assaulted the informant and his family members, due to which they sustained injuries. Ravindra Chaudhary sustained head injury and he fell down on the ground and he was taken to the Hospital for treatment. Later on Ravindra Chaudhary died.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent and there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in this case. The petitioners have been made accused due to mistake of fact. The petitioners are ladies. General and omnibus allegation has been made. No specific overt act is alleged against the petitioners. It is a case and counter case between the parties. The injuries on the side of the accused persons have not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the complaint case/F.I.R.

Considering the facts and circumstances of the case,

No.44685 of 2021(2) dt.15-11-2021 3/3 the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. case No.27/2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
