Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against petitioner is that he took near about Rs. 70,000,00/- (Rupees seventy lacs) from the informant in the name of providing gas agency to him and the aforesaid amount was paid to the petitioner between 30-06-2009 to September, 2013.
The contention on behalf of the petitioner is that the petitioner and the informant were in business transaction and the sister of the informant issued a cheque of Rs. 50,000,00/- (Rupees fifty thousand) and odd on 08-07-2014 but when the aforesaid
Patna High Court Cr.Misc. No.48644 of 2014 (8) dt.13-10-2015 2/2 cheque was presented, the same was bounced. Thereafter, petitioner filed a complaint case and in retaliation to the aforesaid case, the present case has been filed.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with SK Puri P.S. Case No. 234 of 2014 to the satisfaction of Sri Ashutosh Kumar, J.M.-Ist Class, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
