Although petitioner is named in the first information report but he appears to be distant relative of the husband of the deceased. It appears that the learned 4th Additional Sessions Judge, Motihari without applying his judicial mind rejected the prayer for bail of the petitioner.

Moreover, taking into consideration the relation of the petitioner with the husband of the deceased as well as facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S.Case No. 122 of 2014.
