2. The petitioner seeks regular bail in the present case registered for the offence under Sections 8/20(b)(ii)(c)/29 of the NPDS Act.

3. As per the prosecution case, 30 K.G. of Ganja and some other articles were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 18.08.2023. Similarly situated coaccused has been granted bail by this Court in Cr. Misc. No. 84981 of 2023 on 19.03.2024.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.37566 of 2024(2) dt.12-07-2024 2/2 prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Darbhanga/concerned Court below in connection with Bahera P.S. Case No. 346 of 2023.

8. This application stands allowed.
