2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Angarh P.S. Case No. 6 of 2025, lodged on 10.01.2025, under Sections 69/3(5) of the Bhartiya Nyay Sanhita, 2023.
3. As per the prosecution, the FIR has been lodged against four named accused persons. The allegation of rape on the promise of marriage has been alleged in the FIR.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel
Patna High Court CR. MISC. No.34584 of 2025(2) dt.04-06-2025 2/2 submits that the informant is major and she came in contact with the petitioner with full consent. No coercion has been made as it is indicated in the FIR itself. Counsel submits that petitioner is in custody since 18.02.2025 having no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that from the FIR it transpires that Panchayati took place on more than one occasion but petitioner failed to settle this matter.
6. In this background, this Court is not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby rejected.
