Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 144, 149, 447, 341, 323, 308, 380, 354B of the Indian Penal Code.

Prosecution allegation, in short, is that the accused

Patna High Court CR. MISC. No.33200 of 2020(2) dt.24-02-2021 2/3 persons, variously armed, came to the house of the informant and assaulted him and family members due to which they sustained injury.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. No specific overt act is alleged against the petitioners. Specific allegation of assault is alleged against Md. Hamid and Md. Hadish. The nature of injury is said to be simple.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 270/20, subject to the conditions as laid down under Section
