Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Maranchi P.S. Case No. 38 of 2008 registered for the offence under Sections 147, 148, 149, 341, 323 and 379 of the I.P.C. and Section 27 of the Arms Act.

As per the prosecution case, the allegation against the petitioner is that the petitioner assaulted the informant by the butt of the rifle and snatched his watch, Bicycle and Rs. 300/- cash.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.01.2023 and there is no specific allegation against the petitioner.

Patna High Court CR. MISC. No.35067 of 2023(2) dt.12-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the allegation levelled against the petitioner, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Barh, Patna/concerned Court below in connection with Maranchi P.S. Case No. 38 of 2008 subject to the following conditions:- (I) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.

(ii) One of the bailors should be a close blood relative of the petitioner.
