JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although, there is allegation against the petitioner that he attempted to commit rape on ten years old girl but admittedly, petitioner is in jail custody since 05.06.2014 and the impugned order reveals that charge has already been framed against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, Purnea in connection with Special Case No. 17 of 2014 arising out of Barhara (Raghubans Nagar) P.S. Case No. 104 of 2014.

Patna High Court Cr.Misc. No.2335 of 2015 (2) dt.20-01-2015 However, it is made clear that any attempt on behalf of the petitioner to threaten the witnesses shall give liberty to the concerned court to cancel the bail bonds of the petitioner after due enquiry.
