JUSTICE RAKESH KUMAR ORAL ORDER 12-04-2016 Heard Sri Kumar Bikramdeo Singh, learned counsel, who was assisted by Mr. Nafisuzzoha, learned counsel for the petitioner. None appeared on behalf of the State. The petitioner, who is in custody since 6.12.2015 in connection with Kotwali P.S. Case No. 738 of 2015 registered for offence under section 419, 420, 467, 468, 471 , 120 B of the Indian Penal Code and Section 38 of the I.T. Act (correctly 138 of the I.T. Act) has prayed for grant of bail. Learned counsel for the petitioner submits that petitioner had presented a cheque in his account and on suspicion the Branch Manager had lodged a complaint before the Police on the plea that though the address of the company of the petitioner was mentioned but on verification address was not found true.

Learned counsel for the petitioner submits that completely on false accusation petitioner has been made accused and taken into custody. Earlier case diary was called for which has been received.

After hearing learned counsel for the petitioner, considering the period of custody, antecedent of the petitioner, let the petitioner Iliyas Ansari be enlarged on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 738 of 2015 with an indication that if the investigating officer desires any assistance of the petitioner for investigation the petitioner shall render full co-operation to the investigating officer and further that one of the bailors must be blood relation of the petitioner.
