2. The petitioner seeks bail in a case registered for the offence punishable under Sections 137(2) and 96 of the B.N.S., 2023, however charge-sheet was submitted under provisions of POCSO Act also.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant by enticing her for the purpose of marriage.

4. Learned counsel for the petitioner submits, at the outset, that there is a delay of two days in lodging the First Information Report and after recovery, the statement of the

No.33238 of 2026(2) dt.14-05-2026 2/3 victim was recorded under Section 183 of the B.N.S.S. wherein she has stated that she had gone along with friend of the petitioner to Bithauli and from there to Delhi on train and at Delhi Station, she was picked up by the petitioner with whom she went to a room and they stayed together for two days. She has made a specific statement that the petitioner had not established any physical relationship with her and upon information about the present case both came back to Darbhanga. It has also been submitted that the victim has almost reached the age of majority while the petitioner is also a young boy of 21 years of age. The petitioner is in custody since 07.12.2025 and charge-sheet has been submitted.

5. Learned counsel for the opposite party no.2 has also appeared and he has no objection if bail is granted to the petitioner.

Taking into consideration the facts and circumstances and considering the fact that the case seems to have arisen out of love relationship between the petitioner and the victim and there is no allegation of any forceful sexual relationship, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
