JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2015 Petitioner is languishing in custody since 02.11.2014 in a case registered for the offences punishable under Sections 307, 323, 341, 34 of the I.P.C and Section 3⁄4 of the Prevention of Witch Practices Act.
Accusation is assaulting the informant and her daughter by the neighbours including the petitioner. It is further alleged that co-accused Kosumi Devi called the informant as Witch since she had apprehension that her husband died due to the witch practice by the informant. It is submitted by learned counsel for the petitioner that two injuries of marginal size were found on the forehead and scalp. Subsequently one of the injuries was found to be grievous. It is further submitted that accusation is omnibus and general against the petitioner and petitioner is in custody along with her six months old child.
Patna High Court Cr.Misc. No.3601 of 2015 (2) dt.28-01-2015 2/2 Considering the omnibus and general accusation and the fact that petitioner is lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad in connection with Pali P.S. Case No. 20 of 2014.
