BAJANTHRI) 09-09-2024 The appellant has assailed the order of the Family Court's Judgment dated 24.01.2017 passed in Matrimonial Case No. 182 of 2011. Gurudeo Kumar Sharma filed a petition under Section 9 of the Hindu Marriage Act, 1955 for restitution of Conjugal Rights against his wife, opposite party- Suneeta Kumar. Suit was decreed in favour of the applicant/husband, Gurudeo Kumar Sharma against his wife opposite partySuneeta Kumari. Further, it is ordered that opposite party-wife, Suneeta Kumari to join her matrimonial home and to accompany her husband within sixty days from the date of passing of the order.

2. Feeling aggrieved by the aforementioned order, Suneeta Kumari preferred the present miscellaneous appeal in the year 2017. Thereafter, Matrimonial Case No. 81 of 2018 was filed by the husband-Gurudeo Kumar Sharma. Suit was decreed on 08.09.2022 in dissolving the marriage dated 06.07.2011. Thereafter, it is learnt that parties have intended for settlement and it was settled before the Mediation Centre.

3. Taking note of these later developments, the present appeal does not survive for consideration. Thus, the appeal stands disposed of.
