Petitioner seeks bail in a case registered under sections 395 and 397 of the Indian Penal Code.

Earlier prayer for bail of the petitioner along with coaccused Binod Turi @ Binod Kumar Turi and Suresh Sah was rejected by a coordinate bench of this court vide order dated 13.04.2015 passed in Cr. Misc. no. 45967/2014 and analogous case but co-accused Binod Turi @ Binod Kumar Turi and Suresh Sah have already been granted privilege of bail by a coordinate bench of this court. Petitioner is in jail custody since 19.6.2014 and does not have criminal antecedent nor looted articles were recovered from his conscious possession, though it is stated that recovery was made from possession of other accused on the basis of confessional statement of the petitioner.

Considering the aforesaid facts and circumstances as well as

Patna High Court Cr.Misc. No.13073 of 2016 (2) dt.31-03-2016 the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Chandan P.S.
