Petitioner, is in jail custody since 02.11.2015 in a case registered for the offences punishable under Sections 414,419,420/34 of the Indian Penal Code.

The petitioner and others were caught while they were making preparation to commit cheat.

Submission on behalf of the petitioner is that even if the prosecution case is assumed to be true, then also, no case under Sections 414, 419, 420/34 of the Indian Penal Code is made out. It is further submitted that other similarly situated co- accused have been granted bail by this Court by order dated 21.01.2016 in Cr. Misc. No. 1826 of 2016.
