1. The petitioner was dismissed from service in 2015 and he approached this Court challenging the order of dismissal in C.W.J.C. No. 32 of 2018, which was disposed by this Court on 23.11.2021 giving liberty to the petitioner to file appeal before the departmental appellate authority i.e. respondent no. 2. In pursuance thereof, the petitioner filed a departmental appeal before the Director, Primary Education, Patna on 20.12.2021.

2. Learned counsel for the petitioner submits that four years have already passed but the appeal is still pending. No notice as yet has been given to the petitioner fixing the date of hearing of the appeal by the appellate authority.

3. Learned counsel for the state submits that the concerned authority may be directed to dispose the appeal as early as possible.

4. Taking note of the fact that departmental appeal of the petitioner is pending for a very long period, I direct the appellate authority i.e. respondent no. 2 / Director, Primary Education to dispose the departmental appeal of the petitioner in accordance with law within a maximum period of three months from today.

5. With the aforesaid observation and direction, this writ application is disposed.
