JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 307/34 of the Indian Penal Code and sections 3 and 4 of Explosive Substances Act.
The accusation is of making assault to the informant side when specific accusation against petitioner no. 5 is that he used the explosive. Though the splinters of the explosives have been seized from the place of occurrence but no injury has been caused to the informant side.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.2316 of 2015 (2) dt.22-01-2015 2/2 the petitioners' side lodged a case at earlier point of time in which the petitioners' side received injury.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Bahadurpur P.S. Case No. 245 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
