The petitioner, who is in custody since 13.03.2020, seeks bail in connection with Bhagwanpur P. S. Case No. 321 of 2019 dated 29.11.2019, instituted for offences under Sections 395 and 397 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and his name has transpired only in the confession of an arrested accused person. No recovery has been made from the possession of the petitioner.

In the two other cases, in which the petitioner

Patna High Court CR. MISC. No. 32422 of 2020(2) dt.07-12-2020 2/2 was earlier made accused, he has been granted bail. Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bhagwanpur P. S. Case No. 321 of 2019.

The petition stands allowed.
