JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 22-10-2016 The petitioner is aggrieved by the order dated 21.5.2014 passed in Case No. 10 of 2011-12 by the respondent D.C.L.R., Sadar Motihari, East Champaran, as contained in Annexure-1 to the writ petition, whereby aforesaid case filed on behalf of the petitioner under the provisions of The Bihar Land Disputes Resolution Act, 2009 (in short 'Act, 2009') has been dismissed. Indisputably, the impugned order passed by the respondent D.C.L.R. is appealable under Section 14 of the Act, 2009.
not only that, the person aggrieved by the order of the appellate authority shall have further remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of The Bihar Land Tribunal Act, 2009. In above view of the matter, the present writ petition is dismissed, but a liberty is granted to the petitioner to approach the prescribed appellate authority for grant of appropriate relief(s) to him with respect to the lands in question as also the order impugned.
