Petitioner seeks bail in a case registered for the offences punishable under Sections 392 and 395 of the I.P.C. According to FIR, unknown persons looted cash from the informant, a driver of the truck. FIR was registered against unknown.

Submission is that the petitioner is in custody since 02.03.2020 after remand from some other case. Investigation of the case is already complete. Petitioner was never put on T.I.Parade nor any incriminating article was recovered from his possession. Some other co-accused have already been allowed bail by this Court as well as Coordinate Bench of this Court. Only material against the petitioner is his criminal antecedent. Since there is no direct material against the petitioner

Patna High Court CR. MISC. No.32543 of 2020(3) dt.05-02-2021 2/2 in the present case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Durgawati Police Station Case No.18 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
