Petitioner is not named in the first information report but in course of investigation, it came to light that the SIM, through which ransom call was made, had been issued to one Ram Yadav and furthermore, it came to light that the petitioner was a distributor of Vodafone and having misused the photographs of Ram Yadav got issued the SIM in the name of Ram Yadav and after institution of the present case, Ram Yadav lodged Pipra P.S.Case No.172 of 2014 against the petitioner. Admittedly, except the Pipra P.S.Case No. 172 of 2014

Patna High Court Cr.Misc. No.1896 of 2015 (2) dt.19-01-2015 2/2 there is no any other criminal antecedent of the petitioner and the so called SIM as well as mobile had not been recovered from the possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection of Forbesganj P.S.Case No.645 of 2014, G.R.No. 3311 of 2014 (Hemant Kumar Srivastava, J) Namita/- U T
