12-04-2016 Heard Sri Rajeet Kumar Singh, learned counsel for the petitioner and Smt. Pushpa Sinha, learned Addl. Public Prosecutor.
The petitioner, who is in custody in Gopalpur (Rangra) P.S. Case No. 289 of 2015 registered for the offence under Sections 302, 201, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail. Learned counsel for the petitioner submits that only on suspicion, the petitioner has been made accused. He submits that even during investigation, fact has come that deceased had gone with one of the co-accused, Bedo Yadav. With Bedo Yadav, there was some animosity of the deceased. He submits that ofcourse while rejecting the prayer for bail of the petitioner,
Patna High Court Cr.Misc. No.7113 of 2016 (4) dt.12-04-2016 2/2 learned Sessions Judge has referred paragraphs 21, 24, 34, 55 and 56 of the case diary, by way of referring to aforesaid paragraphs, he submits that on the basis of aforesaid fact, only there is suspicion against the petitioner. No direct accusation has been made against the petitioner.
Learned Addl. Public Prosecutor has opposed the prayer of bail, however; she was not in a position to satisfy the Court as to whether there is specific accusation against the petitioner or not. She submits that due to some land dispute, occurrence had taken place.
In view of facts and circumstances, let the petitioner namely Govind Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Naugachhia in connection with Gopalpur (Rangra) P.S.
