The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No.1034 of 2021, registered for the offences punishable under Sections 498(A), 323 and 34 of the Indian Penal Code as well as under Sections 3⁄4 of the Dowry Prohibition Act.
The petitioner, who is husband of the informant, alongwith other in-laws tortured the informant physically and mentally for non-fulfillment of demand of additional dowry. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as
Patna High Court CR. MISC. No.36122 of 2022(8) dt.26-06-2023 2/2 stated in paragraph-3 of the bail petition. It is further submitted that the matter has been compromised between the parties and half of the amount has already been paid to O.P. No.2 as per the agreement between the parties.
Learned counsel for the informant does not deny the factum of compromise between the parties.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali in connection with Hajipur Town P.S. Case No.1034 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
