Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Belaganj P.S. Case No. 680 of 2022 registered for the offence under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 17.12.2022 and he is quite innocent and he has falsely been implicated in the present case. Learned counsel for the petitioner further submits that vehicle in question was not recovered from the possession of the petitioner but the same was recovered from the garage of co-accused Suraj Kumar @ Fotty.

Patna High Court CR. MISC. No.34855 of 2023(2) dt.12-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Except for confession, there is no evidence against the petitioner.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after completing 9 months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gaya/concerned Court below in connection with Belaganj P.S. Case No. 680 of 2022.

The petitioner will mark his attendance at the Jehanabad Police Station on each Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. This application for regular bail stands allowed. (Sandeep Kumar, J) Shishir/- U T
