Petitioner is an accused in a case registered for the offence under sections 411, 414 and 120B of the Indian Penal Code.
Police, acting on a tip off, raided a place and recovered three motorcycles. Petitioner was arrested at the spot and he did not produce papers of the motorcycles. Two coaccused were also arrested on the confession of the petitioner. Learned counsel for the petitioner submits that the allegation against the petitioner is false as he is handicapped and is not able to walk and move freely. He submits that two, out of the three seized motorcycles, belong to his brother who has also filed a petition for release of the said motorcycles. Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl Chief Judicial Magistrate-III, Motihari in Kesariya Police Station Case No. 61 of 2019, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
