====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-07-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Atri P.S. Case No. 566 of 2023 lodged on 31.12.2023 under Sections 304B and 201 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against four named accused persons, including the present petitioner with an allegation of torture and killing the sister of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is an old aged person of about 70 years of age and is in custody since 02.01.2024. The marriage of

Patna High Court CR. MISC. No.37237 of 2024(3) dt.26-07-2024 2/2 grandson of the petitioner was solemnized with the informant's sister. He further submits that husband of the deceased is already in custody and the petitioner has clean antecedent. Father-in-law of the deceased has been granted anticipatory bail but due to old age the police has arrested the petitioner. He further submits that the petitioner is residing separately from the other family members including the husband and wife (deceased).

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
