JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother-in-law of the deceased and omnibus allegation of torturing as well as dowry death has been leveleld against the petitioner and it is surprising enough that the informant disclosed that the marriage of the deceased had taken place in the year 2007 and the deceased died on 6.8.2015, i.e., beyond seven years of her marriage but, even then, not only the first information report was lodged under section 304 B, 201/34 of the Indian Penal Code but charge sheet was also submitted under section 304B of the Indian Penal Code. It is informed on behalf of the petitioner that court has taken cognizance of the offence punishable under section 302 of the

Patna High Court Cr.Misc. No.7240 of 2016 (2) dt.16-02-2016 2/2 Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge -VII, Aurangabad in connection with Sessions Trial No.22 of 2016, arising out of Tandwa P.S.Case No. 34 of 2015.
