The petitioner seeks bail in anticipation of his arrest in connection with Daraunda P.S. Case No. 286 of 2019 instituted for the offences under Sections 341, 323, 324, 353, 307, 504 and 34 of the Indian Penal Code Though in the F.I.R., the petitioner is alleged to have given a blow by sharp cut weapon but the injury on the victim reflects that he was assaulted by hard and blunt substance. There is counter version of the occurrence also. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.32397 of 2020(2) dt.09-02-2021 2/2 that there could not have been any intention of the petitioner to hurt the informant / victim as he had only intervened in the occurrence so as to pacify the parties.
Considering the nature of accusation and taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Siwan, in connection with Daraunda P.S. Case No. 286 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
