The petitioner is accused in connection with Barauni P.S. Case No. 374 of 2015, registered under Section 395 and 412 of the Indian Penal Code.
The accusation is that petitioner along with four others named in the F.I.R. were trying to commit theft of wire of transformer and all the accused persons caught hold on the spot. Learned counsel for the petitioner submits that chargesheet has already been submitted against the petitioner and others and similarly situated co-accused, Diwali Bind and Rajan Paswan have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 29.02.2016 and 24.02.2016 passed in Criminal Misc. No. 6394 of 2016 and Cr.
Patna High Court Cr.Misc. No.9040 of 2016 (2) dt.18-03-2016 2/2 Miscellaneous No. 5348 of 2016, respectively. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 374 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
