Petitioner seeks bail in Bagaha P.S. Case No.385 of 2018 instituted for the offence under Section(s) 302, 316/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner is younger brother of husband of the deceased.

In the written report, it is alleged that on the date of occurrence husband of the deceased along with this petitioner and another accused came to the house of the informant and son-in-law of the informant assaulted his daughter with dagger and thereafter all of them fled away.

In this manner, there is no allegation of any specific overt act against the petitioner in the written report.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S.
