The petitioner was Panchayat Secretary at the relevant time and accusation against him is that he misappropriated the amount, which had been taken by him and coaccused, Arvind Kumar Yadav for construction of community hall under government scheme.

The contention on behalf of the petitioner is that the community hall was constructed by the petitioner and co-accused, Arvind Kumar Yadav but in course of inquiry, it was found that sub-standard materials were used in construction work and the construction work was left incomplete.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Fulkaha P.S. Case No. 26 of 2013 to the satisfaction of Chief Judicial Magistrate, Araria.
