In this case, the petitioner is seeking bail in connection with Sitamarhi P.S. Case No. 86 of 2014 registered for offences under sections 307/34/120(B) of the Indian Penal Code and Section 27 of the Arms Act.
In the first information report, it has been alleged that some unknown persons fired upon the victim who received injury, was treated in the Hospital. The name of Subhash Chandra Jha has surfaced and it has been said, there is litigation between the victim and Subhash Chandra Jha. During investigation two witnesses, namely, Jamir and Jakir have identified, just after accident, it was found that the petitioner and other co-accused were running from
Patna High Court Cr.Misc. No.7709 of 2016 (4) dt.22-04-2016 2/2 there and this petitioner was carrying country-made pistol. The petitioner has plenty of past criminal cases. In such view of the matter, this Court does not feel inclined to grant bail to the petitioner. Accordingly, this petition is rejected. The court below is directed to expedite the trial and conclude the same within a period of one year from the date of receipt/production of a copy of this order. If the trial is not concluded by the aforesaid period, the petitioner may renew his prayer for bail.
