JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-03-2019 By order dated 25.04.2017, passed in CWJC No. 14230 of 2016, violation of which is being complained of in the present contempt application, this Court had directed the Lalit Narayan Mithila University, Darbhanga to ensure that a report is submitted by a team, constituted by the University for the purpose of grant of No Objection Certificate and a decision is taken on the basis of the said report within a reasonable time and, in no case, later than three months from the date of receipt/ production of the order.

A show cause has been filed on behalf of opposite party nos. 1 to 3, stating therein that the order stands complied

Patna High Court MJC No.693 of 2018(4) dt.13-03-2019 2/2 with, inasmuch as after submission of the report of the inspection team, to examine the feasibility for granting N.O.C. for additional 100 intake in B.Ed. Course in petitioners' College, for obtaining recognition from the National Council for Teacher Education, a decision has been taken based on the report of the inspection team, as directed by this Court. The petitioners are apparently aggrieved by the decision of the University, whereby the request of the petitioners for grant of N.O.C. has been rejected.

In view of what has been averred in the show cause, filed on behalf of the opposite parties, I do not think that a case of deliberate disobedience of this Court's order is made out. The petitioners shall be at liberty to question the correctness of the decision of the University, in accordance with law.
