The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code. The prosecution case in short is that while the informant was returning from Hazipur, at way, the accused persons intercepted him and in consequence thereof, he was assaulted and was snatched away Rs. 10,000/- from his pocket. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-12-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. There is allegation of

Patna High Court CR. MISC. No.33463 of 2019(3) dt.20-06-2019 2/2 assault by means of knife and of committing theft. No stolen property is alleged to have been recovered from possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur in connection with Hajipur Sadar P.S. Case No. 765 of 2018.
