The petitioner is languishing in custody since 19.12.2015 in a case registered for the offences punishable under sections 489A, 489B,489C/34 of the Indian Penal Code and 20,22,24,27 and 29 of The Narcotic Drugs and Psychotropic Substances Act, 1985.

Three persons namely, Noor Alam, Afroz Alam and Sabhapati Ram, the petitioner before this Court, were intercepted while travelling on two motorcycles when from the co-accused Noor Alam twenty counterfeit currency note of rupees one thousand were recovered whereas 4 kg. 'charas' was recovered from the motorcycle of co-accused Noor Alam and Afroz Alam and 500 gms. 'charas' were recovered from the motorcycle of

It is submitted by learned counsel for the petitioner that the petitioner was not aware about the 'charas' being kept in the motorcycle. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and the recovery is between the small and commercial quantity. Moreover, the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran (Bettiah) in connection with Bairiya P.S. Case No.315/2015.

The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence. (Dinesh Kumar Singh, J) Ashwini/- U T
