JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-02-2022 Heard Mr. Praveen Kumar Agrawal, learned counsel for the petitioner and Mr. Ashok Kumar Singh, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Parbatta P.S. Case No. 09/2021 registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code 1860.

As per the First Information Report, the petitioner along with other accused persons, on gun point, kidnapped the minor daughter of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and there

Learned counsel further submits that the girl was recovered and her statement under Section 164 Cr. P.C. has been recorded in which she has disclosed her age as 20 years and has stated that she left the house on her own will and has solemnized marriage with co-accused Manoj Sahni in a temple at Delhi. The petitioner is uncle of co-accused Manoj Sahni, he is in custody since 20.01.2021 and charge sheet has already been submitted. Regards being had to the submission made by the parties and taking into consideration the statement of victim girl recorded under Section 164 Cr. P.C., the fact that the petitioner is in custody since 20.01.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Parbatta P.S. Case No. 09/2021.
