The petitioner seeks bail in Nabinagar P.S. Case No. 34 of 2014 registered under section 302/34 of the Indian Penal Code.

According to the prosecution case Krishna Paswan the informant learnt that a dead body was lying out side the house of one Shiv Kumar. The informant further disclosed that a thief had entered in the house of Shiv Kumar but the village caught and brutally assaulted him causing his death. Learned counsel for the petitioner submits that petitioner is of course named in the first information report but no specific allegation of assault is made against the petitioner. Other accused persons have already been enlarged on bail vide

Patna High Court Cr.Misc. No.3975 of 2015 (2) dt.29-01-2015 2/2 Cr. Misc. No.40381 of 2014 and 24815 of 2014. Considering the fact that villagers caught the victim and assaulted him and there is no specific allegation against the petitioner although petitioner is named in the first information report, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial magistrate Aurangabad in Nabinagar P.S. Case No. 34 of 2014..
