JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 406, 409, 379 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have misappropriated Rs. Three Lakhs.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. As a matter of fact petitioner was an employee and informant owed him Rs. 1,20,000/- of his salary which was repeatedly demanded by the petitioner, which he was not ready to pay. Due to that this false case has been lodged by the informant.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.43340 of 2021(8) dt.05-07-2022 2/2 prayer for anticipatory bail and submits that there is specific and direction allegation against this petitioner of defalcation of money and processes u/s 82/83 of the Cr.P.C has already been initiated against this petitioner.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
