The petitioner seeks regular bail in a case registered under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The complainant made allegation against the petitioner that the petitioner demanded money and motorcycle. The petitioner assaulted his wife.
Learned counsel for the petitioner submits that the marriage was solemnized in the year 2004 and after 9 years of marriage, this case has been filed only because the wife could not be able to give birth to a child. Some dispute arose between the husband and the wife.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.3135 of 2015 (2) dt.22-01-2015 2/2 petitioner is in jail since 28.11.2014, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kaimur (Bhabua) in Complaint Case No. 651 of 2013 giving rise to Tr. No. 2659/2014.
