No doubt, petitioner was caught on the spot but it is admitted case of the prosecution that petitioner was driver of the seized vehicle and it were other accused who hired the vehicle of the petitioner and took him near the place of occurrence. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 25.12.2015. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Simultalla P.S. Case no. 54/2015.
