The petitioner, who is in custody since 8.10.2014 in connection with Sasaram (Town) P.S. Case No. 934 of 2014 registered for the offence under Section 364, 365, and 302 of the Indian Penal Code, corresponding to Sessions Trial No. 83 of 2015, has prayed for grant of bail.

Learned counsel for the petitioner submits that save and except the fact that petitioner was lastly seen with the deceased there is no other material. Earlier case diary was called for which has been received. I have myself examined the case diary. Fact remains that after commitment trial has already commenced and till date as accepted by Sri Pandey, learned counsel for the petitioner, three prosecution witnesses have already been

Patna High Court Cr.Misc. No.6964 of 2016 (3) dt.12-04-2016 2/2 examined and the fact that evidence is going on, it would not be appropriate to pass order for grant of bail. The prayer for bail stands rejected.

However, keeping in view the fact that petitioner is in custody since 8.10.2014, while dismissing the present petition it is desirable to observe that the learned trial court as well as the prosecution may take appropriate steps for early disposal of the case.
