JUSTICE RAJ KUMAR ORAL ORDER (Per: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH) 07-07-2026 At the outset, while assailing the impugned order dated 22.05.2024 passed by the Ld. Central Administrative Tribunal, Patna Bench, Patna (hereinafter referred to as the 'Ld. CAT') in OA No. 050/00601/2023 and other analogous cases totaling five in all, the Ld. Counsel for the petitioner has submitted that in the aforesaid order dated 22.05.2024 only the submissions and the factual aspect of the matter pertaining to the case of Deepak

No. 050/00546/2023) has been dealt with, however the factual aspect of the case of the petitioner herein, which is quite different from that of the said Deepak Kumar has not been dealt with resulting in grave prejudice to the petitioner, hence the petitioner be granted liberty to file a review petition before the Ld. CAT for review of the order dt. 22.05.2024 passed in O.A. No. 050/00601/2023, nonetheless it is requested that some time be stipulated for disposal of the review petition. 2.

The Ld. Counsel for the respondents does not have any serious objection in case liberty is granted to the petitioner to prefer a review petition before the Ld. CAT against the order dt. 22.05.2024.

Having regard to the submissions advanced by the Ld. Sr. Counsel for the petitioner, we deem it fit and proper to grant liberty to the petitioner to file appropriate review petition before the Ld. CAT for review of the order dt. 22.05.2024 passed in O.A. No. 050/00601/2023 and in case such a review petition is filed before the Ld. CAT within a period of three weeks from today, the same would be heard on merits and disposed of expeditiously.

Since the matter in issue pertains to grant of appointment on compassionate ground to the petitioner, we feel persuaded to

CAT to hear and dispose of the review petition, to be filed by the petitioner, preferably within a period of three months of filing of counter affidavit by the respondents herein in the review petition to be filed by the petitioner. 5.

It is needless to state that the petitioner shall be at liberty to raise all such issues which have been raised in the present writ petition, in the review petition to be filed before the Ld. CAT.

Accordingly, the present writ petition stands disposed of, however with the aforesaid liberty.
