Petitioner is in jail custody since 05.05.2006 in a case registered under sections 328,379,307 and 411/34 of the Indian Penal Code and sections 20& 22 of the N.D.P.S Act. According to the prosecution case itself, the alleged occurrence took place on 02.05.2014 and petitioner as well as one Jagtarni Devi are said to be arrested on 03.05.2014 and thereafter, petitioner and Jagtarni Devi were produced before the informant, who claimed to have identified the petitioner and co-accused Jagtarni Devi. Allegedly, the stolen purse of the informant was recovered from possession of the petitioner.
Patna High Court Cr.Misc. No.2659 of 2015 (3) dt.17-04-2015 2/2 Learned counsel for the petitioner submits that petitioner has been implicated in this case on mere suspicion and moreover, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Judge cum Special Judge (N.D.P.S), Samastipur in connection with Samastipur Rail P.S.Case No. 36 of 2014.
