The petitioner seeks regular bail in Darbhanga Rail P.S. Case No. 15 of 2014, registered for the offences punishable under Sections 395, 397 and 412 of the Indian Penal Code.

The petitioner is not named in the First Information Report. Nothing has been recovered from the possession of the petitioner. One looted mobile was recovered from the possession of Gaurav Kumar @ Banti. Gaurav Kumar @ Banti is said to have disclosed that he received the mobile from his maternal uncle, namely, the petitioner Sunil Mandal. Gaurav Kumar @ Banti co-accused also confessed except the confessional statement of co-accused, the police did not collect any tangible evidence. Petitioner was not put on Test Identification Parade and

Patna High Court Cr.Misc. No.2204 of 2015 (2) dt.19-01-2015 he is in jail since 24.04.2014.

Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate 1st Class, Samastipur in connection with Darbhanga Rail P.S. Case No. 15 of 2014.
